این تحقیق به تحلیل و واکاوی مبانی حقوقی و فقهی تأسیس «کمیسیون جلوگیری از غصب زمین و استرداد زمینهای امارتی و املاک دولتی» با تاکید بر رویکرد عملکردی «کمیسیون معطوف به کارکرد محکمهی اختصاصی رسیدگی به قضایای زمین غصبی» در چارچوب نظام امارت اسلامی افغانستان میپردازد. نگارش این مقاله مبتنی بر فرمان شماره ۹ امیرالمومنین و پس از آن، قانون جلوگیری از غصب زمینها و استرداد زمینهای امارتی و طرزالعمل تطبیق فیصلهی کمیسیون جلوگیری از غصب زمینها و استرداد زمینهای امارتی تصویب گردید. توشیح این قانون و اصولنامه با هدف استرداد و جلوگیری از غصب زمینهای امارتی، چراگاههای عمومی و وقفی، مقابله با تصرفات غیرقانونی، استرداد املاک دولتی و تنظیم نظام مالکیت زمین در افغانستان انجام شده است. نوع تحقیق کاربردی و روش آن توصیفی-تحلیلی است. مهمترین یافتههای تحقیق نشان میدهد که ساختار حقوقی-اداری بر پنج هدف اصلی استوار است: تقدم منافع عامه بر منافع فردی، تثبیت مالکیتهای مبهم ناشی از جنگها، بینظمیهای اداری و فساد گستردهی دورهی جهاد و جمهوری، تامین زمین برای اعمار پروژههای عام المنفعه، مستندسازی و ثبت املاک غیرمنقول امارتی-حکومتی و تحکیم اقتدار سیاسی نظام امارت از طریق مدیریت، اجارهدهی و بهرهبرداری اقتصادی از زمینها انجام گردیده است.
This study analyzes and examines the legal and jurisprudential foundations of the establishment of the Commission for the Prevention of Land Grabbing and the Restitution of Emirate and State Lands, with particular emphasis on the Commission’s functional approach in relation to the role of the Special Court for Adjudicating Land Grabbing Cases within the framework of the Islamic Emirate of Afghanistan. The article is based on Decree No. 9 of the Amir Al-Mu’minin, followed by the enactment of the Law on the Prevention of Land Grabbing and the Restitution of Emirate Lands and the Procedure for the Implementation of the Decisions of the Commission for the Prevention of Land Grabbing and the Restitution of Emirate Lands. The promulgation of this law and procedural regulation was undertaken with the objectives of recovering and preventing the grabbing of Emirate lands, public grazing lands, and waqf properties; combating unlawful occupation; restoring state-owned properties; and regulating the land ownership system in Afghanistan. The research is applied in nature and employs a descriptive–analytical methodology. The principal findings indicate that the legal and administrative framework is founded upon five main objectives: prioritizing the public interest over private interests; clarifying ambiguous land ownership resulting from wars, administrative disorder, and widespread corruption during the Jihad and Republic periods; providing land for the construction of public-benefit projects; documenting and registering Emirate/government immovable properties; and consolidating the political authority of the Islamic Emirate through the administration, leasing, and economic utilization of land.
