رهن رسمی یکی از نهادهای بنیادین تضمین دیون در نظام حقوقی افغانستان است که با هدف تامین حقوق داین و ایجاد اطمینان در روابط معاملاتی، بهویژه در حوزهی اموال غیرمنقول، مورد استفاده قرار میگیرد. قانون مدنی افغانستان با شناسایی نهاد رهن و تقسیم انواع آن در مادهی ۴۸۷، چارچوب کلی این نهاد حقوقی را ترسیم نموده است. با اینحال، ماهیت حقوقی رهن رسمی از حیث اینکه تنها یک تعهد قراردادی تابع دین است یا واجد وصف حق عینی تبعی مستقل میباشد، همچنان محل بحث و تفسیرهای متفاوت حقوقی است. مسئلهی اصلی این نوشته، تبیین دقیق ماهیت حقوقی رهن رسمی و تعیین جایگاه آن در میان حقوق عینی و حقوق تعهدات در نظام حقوقی افغانستان است. اهمیت و ضرورت این تحقیق از آنجا ناشی میشود که ابهام در ماهیت حقوقی رهن رسمی میتواند منجر به اختلاف رویهی قضایی، کاهش امنیت حقوقی معاملات و تضعیف نقش تضمینی رهن در روابط اعتباری و بانکی گردد. از اینرو، بررسی ماهیت حقوقی این نهاد برای انسجام نظام حقوقی و حمایت موثر از حقوق طرفین معامله ضروری به نظر میرسد. این تحقیق با رویکرد توصیفی-تحلیلی و با اتکا بر تحلیل ساختار قانونی رهن در حقوق افغانستان انجام شدهاست. یافتههای تحقیق نشان داد که رهن رسمی، علیرغم وابستگی ذاتی به دین، واجد اوصاف اساسی حق عینی تبعی است که با ثبت رسمی بر مال غیرمنقول تحقق مییابد و آثار آن نه تنها میان طرفین، بلکه در برابر اشخاص ثالث نیز قابلیت استناد دارد؛ امری که جایگاه رهن رسمی را به عنوان یکی از مهمترین ابزارهای تضمین تعهدات مالی در نظام حقوقی افغانستان تثبیت میکند.
A registered mortgage is one of the principal legal mechanisms for securing obligations under Afghan law, aimed at protecting creditors' rights and ensuring legal certainty in transactions, particularly those involving immovable property. The Civil Code of Afghanistan recognizes mortgages and classifies their types under Article 487, providing the general legal framework for this institution. However, the legal nature of a registered mortgage remains a subject of debate as to whether it is merely a contractual obligation accessory to the underlying debt or an accessory real right. This study examines the legal nature of the registered mortgage and its position within the framework of real rights and the law of obligations in Afghanistan. The significance of this research lies in the fact that uncertainty regarding the legal characterization of registered mortgages may lead to inconsistent judicial practice, reduced legal certainty in transactions, and weakened protection of credit and banking relationships. The study adopts a descriptive-analytical approach based on an examination of the relevant provisions of Afghan law. The findings indicate that, although a registered mortgage is dependent upon the secured debt, it possesses the essential characteristics of an accessory real right. Once formally registered over immovable property, its legal effects are enforceable not only between the contracting parties but also against third parties. Accordingly, the registered mortgage constitutes one of the most significant legal instruments for securing financial obligations under Afghan law.
