تحلیل حمله‌ی اسرائیل به غزه از چشم‌انداز حقوق بین‌الملل بشردوستانه

اسرائیل کشوری است که در سال ۱۳۲۷ هـ.ش، با حمایت قدرت‌های غربی تاسیس شد. تاسیس این دولت در سرزمین فلسطین و تحمیل آن بر جغرافیای بومی فلسطینی‌ها، از همان آغاز، موجب شکل‌گیری تنش‌ها و خصومت‌های پایدار میان اسرائیل و مردم فلسطین شده است. این تنش¬ها منجر به درگیری¬های خونین نیز شده، اما فلسطینی¬ها، ایستادگی و مقاومت را در قبال تجاوز صریح اسرائیل به کشورشان، بر بنیاد حقوق بین¬الملل به مثابه¬ی حق خویش محفوظ می¬دانند. هدف تحقیق¬ حاضر، بررسی رعایت حقوق بشردوستانه در پرتو تجاوز اسرائیل در غزه، پس از عملیات «طوفان الاقصی» است. در چنین وضعیتی، این پرسش مطرح می‌شود که آیا در حملات گسترده‌ی اسرائیل، حقوق بشردوستانه رعایت شده ¬است؟ به‌نظر میرسد، باتوجه به وسعت حملات رژیم اسرائیل و کاربرد تسلیحات نوین نظامی با تخریب وسیع از یک¬سو و حملات به مناطق غیرنظامی، اماکن عام¬المنفعه و کشتار غیرنظامیان از سوی-دیگر، از مصادیق بارز نقض حقوق جنگ شمرده می¬شود. در این نوشته، از روش کیفی، از نوع توصیفی – تحلیلی استفاده شده است. یافته‌های تحقیق به صراحت نشان می‌دهد که با در نظرداشت آمار تکان¬دهنده از تلفات انسانی و حجم عظیم از خسارات مالی و مادی که رژیم اسرائیل پس از میزان 1402 بر مردم غزه تحمیل کرده است، هیچ‌یک از معیارهای حقوق بشردوستانه در این جنگ از جانب صهیونستان رعایت نشده است.

An Analysis of Israel’s Attack on Gaza from the Perspective of International Humanitarian Law

Israel is a country established in 1948 (1327 AH) with the support of Western powers. The founding of this state on the land of Palestine and its imposition upon the indigenous geography of the Palestinians has, from the outset, led to persistent tensions and hostilities between Israel and the Palestinian people. These tensions have also resulted in bloody conflicts; however, Palestinians consider steadfastness and resistance against Israel’s explicit aggression toward their country as their right based on international law. The present study aims to examine the observance of humanitarian law in light of Israel’s aggression in Gaza following the “Al-Aqsa Storm” operation. In this context, the question arises whether humanitarian laws have been respected during Israel’s extensive attacks. Given the scale of the Israeli regime’s attacks, the use of modern military weapons causing widespread destruction on one hand, and assaults on civilian areas, public utilities, and the killing of non-combatants on the other, these acts clearly constitute violations of the laws of war. This paper employs a qualitative descriptive-analytical method. The findings explicitly indicate that, considering the shocking statistics of human casualties and the vast financial and material damages imposed by the Israeli regime on the people of Gaza since 2023 (1402 AH), none of the humanitarian law criteria were respected by the Zionists during this war.
